HP Answers Defendants’ Counterclaims in Copycat Trade Dress Case


On November 29, HP answered counterclaims brought against it by five defendants whom HP sued for infringing the trade dress of HP ink and toner cartridges. The defendants’ counterclaims asked the court for declaratory judgments of noninfringement as well as declaratory judgments that HP’s trade dress is invalid and is not protectable intellectual property.
